Abstract

Abstract:


This research studies: “Symptoms of incompetence among fundamentalists, an applied fundamentalist study on the disease.” It included an introduction, containing: the importance of the research, the reasons for choosing it, its objectives, previous studies, its methodology, and its procedures.


An introduction to the concept of eligibility among fundamentalists.


It also included two sections under which a number of sections fell: The first section was about: the concept of civil symptoms and their types, while the second section was about: the concept of illness and its types, and its impact on mandatory and positive rulings. It included four topics, the fourth of which was applications on the effects of illness.


As for the study method: it followed the inductive-deductive, descriptive, historical, analytical, and comparative approaches.


At the conclusion of the research, I concluded with a number of results and recommendations. Among the most important results were: highlighting the trends of scholars in controlling the feared disease, their differences in it, and the difficulty of defining it, the ancient jurists’ description of the feared disease, and explaining the influential difference in the ancient jurists’ depiction of the feared disease in our contemporary reality, and the opinion. Modern jurisprudence and medicine on feared illness, and the necessity of seeking help from modern medicine to approximate the majority of suspicion.


The study also recommended in its conclusion: to stop quoting the description of the advanced jurists of the disease that is frightening due to the development of modern medicine, and to deepen the studies in determining the jurisprudential control that is compatible with modern medicine, and the necessity of classifying the appropriate jurisprudential control that specifies the original that does not change and the control that can be developed, and to leave space for the judgment of specialists in medicine. When presenting the jurisprudential opinion, and not describing diseases at all
