Abstract

 


Abstract. This study is concerned with gastric sleeve surgery, which involves removing part or all of the stomach to reduce weight by making a longitudinal incision in the stomach in both men and women. Obesity is the primary cause of fat accumulation in the body, and a gastric sleeve operation is the fastest way to lose it. Weight loss is the most famous benefit of gastric sleeve surgery, but there are many other types and benefits as well. Additionally, there are complications and harms after gastric Sleeve surgery, most notably sagging after surgery, which also results in high costs. The measurement of obesity is based on the methods chosen by doctors. This study revealed that obesity has many causes, not just one, that contribute to weight gain, and that it has disadvantages that may affect the marriage contract for both spouses. As a result, any act that alienates one spouse from the other and fails to achieve the goal of marriage, such as intercourse, enjoyment, diminishing sexual desire, mercy, and affection, can be considered a defect. Sleeve gastrectomy defects and tightening of sagging skin can be attributed to the shared defects between spouses, as with leprosy, which is a lifelong defect, and sagging skin in the body after a sleeve gastrectomy may not be reparable, thus causing psychological harm to the other spouse. The current study concluded that the spouse does not have the right to terminate a marriage contract if one of the spouses was aware of the defect before or after the contract was signed. However, if the defect is discovered after copulation, it is most likely that one of the spouses will be entitled to terminate the marriage due to the defect. In other words, due to the lack of enjoyment that occurs as a result of the sleeve gastrectomy on both the man and woman, either of them is entitled to terminate the marriage contract as a result of the lack of fulfillment and enjoyment.
