Abstract

This study aims to achieve three objectives: 1. To analyze the provisions of the Saudi Civil Transactions Law regarding rescission due to breach of performance. 2. To examine the stance of Hanbali jurisprudence regarding rescission due to breach of performance, and to compare it with the position of the Civil Transactions Law. 3. To compare unilateral rescission and judicial rescission.
